3.4 Management's Rights |
|
|
|
|
|
3.4.1 Subject to the terms and conditions of this Part, an
Employer has the right:
- to maintain order, discipline and efficiency; to make,
alter and enforce rules and
regulations, policies and practices, to be adhered to by
its Employees; to
discipline and discharge Employees for just cause;
- to select, hire and direct the working force and
Employees; to transfer, assign,
promote, demote, classify, layoff, recall and suspend
Employees; to select and
retain Employees for positions excluded from the bargaining
unit;
- to operate and manage its business in order to satisfy
its commitments and
responsibilities, including the right to determine the kind
and location of business
to be done by it, the direction of the working forces, the
scheduling of work, the
number of shifts, the methods, processes and means by which
work is to be
performed, job content, quality and quantity standards, the
right to use improved
methods, machinery and equipment, the right to determine
the number of
Employees needed by it at any time and generally, the right
to plan, direct and
control its operations without interference.
3.4.2 The sole and exclusive jurisdiction over operations,
building, machinery, equipment will
be vested in Employers, the Owner, or HCML, as the case may
be.
3.4.3 Employers may contract out Work where:
- they do not possess the necessary facilities or
equipment;
- they do not have and/or cannot acquire the required
Employees; or
- they cannot perform the work in a manner that is
competitive in terms of cost,
quality and within required time limits.
When practical, prior to subcontracting, Employers will
discuss with CEP the portion or
portions of the Project that the Employer wishes to
sub-contract and the subcontractors to
be hired to do such Work.
