Article 13 - Transportation, Travel and Accommodation |

|
13.01 Preamble
- It is recognized by the Employer and the Union that the
purpose of transportation, travel and accommodation allowances
as established in this article, is to provide a fair means of
compensating employees for additional travel and accommodation
expenses they incur while working on jobsites beyond a
reasonable distance from their residence.
- For the purposes
of this Agreement, the Employer's base of operations is
defined as Vancouver, Nanaimo or the job site. The base of
operation will be determined at the pre-job conference.
- For
selected job sites with peculiar geographic circumstances, the
Employer and the Union, by mutual agreement may establish
alternative or amended policies for transportation, travel and
accommodation. Such alternative or amended policies will be
established for the duration of the job site and will be put
into writing and signed by a representative of the Employer
and the Union.
13.02 Local Residents and Travel and Accommodation Zones
- Transportation and accommodation zones of fifty-five (55)
and eighty (80) kilometres by road are established from the
Employer’s base of operations.
- A bona fide local resident
will be defined to mean any person residing within eighty (80)
kilometers by road of the project or, where ferry travel is
involved, within seventy-five (75) minutes travel time
including ferry travel and road kilometers and has resided
within such distance of the site for a period of not less than
thirty days prior to the commencement of the project.
13.03 Daily Travel
- Local residents (as defined in Article 13.02 b)) residing
within fifty-five (55) road kilometers of the job site shall
not be entitled to receive daily transportation expense,
initial and return transportation expense, room and board or
subsistence, or camp accommodations, or rotational leave
provisions.
- Local residents residing between fifty-five (55)
road kilometers and eighty (80) road kilometers of the job
site shall not be entitled to receive initial and return
travel time or expense, room and board or subsistence, or camp
accommodations, or rotational leave provisions, but shall be
paid a transportation expense of an amount to be determined at
the Pre-Job Conference, each way to cover transportation
expense for each day worked.
- There will only be daily travel
beyond the eighty (80) road kilometers upon the mutual
agreement of the parties.
- When the Employer provides
transportation to the jobsite, there is no daily travel
allowance.
13.04 Initial/Shift Travel Allowance
- For projects whose base of operations is defined as
Vancouver or Nanaimo there is no initial or shift Travel
Allowances.
- For projects whose base of operations is defined
as the job site, the initial and shift travel allowances will
be based on the following criteria:
- Initial and shift travel
allowances will be paid only to employees whose permanent
residence is beyond eighty (80) kilometres by road;
- all
travel allowance will be paid from the Union’s Vancouver
office up to eighty (80) kilometres by road from the job site;
- initial travel allowance will be paid for the beginning
of the project, and again, if the employee is laid off and
recalled to the same project. Employees who quit or are
terminated for just cause within twenty-one (21) work days of
their start date will not receive initial travel allowance.
- employees will receive travel allowance for every completed
shift cycle as defined in the Pre-Job Conference for the
project. Such travel allowance will be paid provided the
employee returns to work on the next shift cycle or is laid
off by the Employer. Payment will be made on the employees
following pay cheque.
- the amount of initial and shift cycle
travel allowance is subject to negotiation and agreement
between the Employer and the Union. The cost of public
transportation, duration of travel from the Union’s
Vancouver office, and other unique features of the project
will be used as guidelines. The amount of travel allowance
will be indicated on the Pre-Job Conference report.
- If the
Employer provides transportation to the jobsite, there shall
be no initial or shift cycle travel allowance.
13.05 Accommodation Allowance
- No accommodation allowance shall be paid for Local
Residents as defined in Article 13.02 b).
- For projects whose
base of operations is defined as the job site, accommodation
allowance will be paid for all employees whose permanent
residence is beyond eighty (80) road kilometres from the job
site.
- Daily accommodation allowance will be paid as
determined at the Pre-Job Conference. The minimum
accommodation allowance will be $75.00 per day worked.
- Employees receiving accommodation allowance will not be
entitled to daily travel allowance unless the Employer and
Union agree that there is no accommodation available within
the fifty-five (55) road kilometres from the job site.
Employees in this situation, who provide their own
transportation, will receive a daily travel allowance
determined in the Pre-Job Conference.
13.06 Travel Time
- On all projects, regardless of accessibility or isolation,
where an employee transports an Employer’s vehicle to the
job, such employee will be paid his regular rate of pay for
actual time traveled. Such employees will not receive
duplicating travel allowance.
- On all projects, regardless of
accessibility or isolation, where an employee’s
classification requires the use of his own vehicle in the
performance of his duties, such employee will be paid at his
regular rate of pay for actual (reasonable) time traveled from
the point of hire to the project and return.
13.07 Transfers
Stipulated rates of pay will be paid in all cases of transfers
from one project to another irrespective of Articles 13.02,
13.03 and 13.04.
13.08 Turnarounds
During the course of a project the work schedule may provide
for turnaround periods to allow employees reasonable time off.
This time and cost reimbursement will be subject to agreement
by the Employer and Union at the appropriate pre-job
conference.
